PODCAST GUEST WAIVER AND PARTICIPATION AGREEMENT

This Guest Waiver and Participation Agreement (“Agreement”) is made between Michael S. Parker / Forge Fitness and Nutrition Coaching LLC, owner and producer of The Forge Podcast (“Host”), and the undersigned guest (“Guest”). By signing this agreement, the guest agrees to the following terms and conditions. To ensure a smooth and high-quality podcast recording, please review the included checklist before your scheduled appearance.

 

Permission to Record and Use Likeness

Guest grants Host full permission to record, edit, publish, distribute, and monetize audio, video, and/or written content from their participation on The Forge Podcast. This includes Guest’s voice, image, likeness, name, and any shared stories or experiences, across all platforms, in perpetuity. Guest acknowledges that the final content may be edited at the Host’s discretion and may be used in promotional material, advertising, or future media projects without additional approval or compensation.

 

Content Ownership

All rights, title, and interest in the podcast episode(s) and any derivative works remain the sole property of the Host. Guest waives any right to royalties or other compensation arising from or related to the use of the recording.

 

Guest Representations

Guest affirms that:
- They are participating voluntarily.
- They will not knowingly make false or defamatory statements during the recording.
- They have the authority to speak about any topics they present, and will not infringe on any third-party rights (e.g., copyrighted materials, confidential information).

 

Disclaimer of Endorsement

Guest understands that appearance on the podcast does not imply an endorsement of Guest, their business, or personal views by the Host. Similarly, the views and opinions expressed by the Guest do not necessarily reflect those of the Host, podcast, sponsors, affiliates, or production team.

 

Release of Liability

Guest releases and discharges the Host, its affiliates, contractors, officers, and employees from any and all claims, demands, or causes of action arising out of or in connection with the podcast recording, including but not limited to claims for libel, slander, invasion of privacy, infringement of rights, or violation of publicity rights.

 

Confidentiality and Conduct

Guest agrees to keep any sensitive production-related information confidential unless otherwise authorized. Professional and respectful conduct is expected before, during, and after the podcast appearance.

 

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

 

TECHNICAL REQUIREMENTS

 

Internet Connection

  • Ensure a stable, high-speed internet connection (minimum 10 Mbps upload speed).

  • A wired Ethernet connection is strongly recommended over Wi-Fi for reliability.

  • Close all non-essential applications and browser tabs to reduce bandwidth usage.

  • You may test your speed at speedtest.net.

 Microphone

  • Please use an external microphone (e.g., USB or XLR) for optimal audio quality.

  • Built-in laptop or mobile device microphones are discouraged due to poor sound clarity.

 Headphones

  • Use headphones to avoid audio feedback and echo.

  • Ideally, use low-profile or in-ear headphones to maintain a clean visual appearance.

 Camera/Webcam

  • A high-definition webcam (1080p or better) is preferred.

  • Position the camera at eye level, and ensure the lens is clean.

  • Frame your shot to include your head and upper shoulders, with a small amount of headroom.

 Lighting

  • Use soft, front-facing lighting for even illumination.

  • Natural light is acceptable if diffused and consistent; avoid harsh shadows or backlighting.

  • If indoors, a ring light or softbox light is recommended for a professional presentation.

  • If using natural light, consider sun position and cloud cover that can cause lighting fluctuations.

 Background

  • Choose a tidy, distraction-free background.

  • Neutral or branded settings are ideal.

  • Remove any items that may appear unprofessional or draw attention away from the conversation.

 Punctuality

  • Please join the virtual meeting 10 minutes prior to the scheduled start time to perform a tech check.

 Notifications

  • Silence your phone, email alerts, and other notifications during the recording.

 Demeanor

  • Speak clearly and maintain a conversational tone.

  • Remain engaged throughout the recording — visual responsiveness helps maintain listener interest, even in audio-only formats.

 Hydration

  • Have water nearby in case of dry mouth or coughing.

 Minimize Distractions

  • Inform others in your environment that you will be recording.

  • Close doors and mute any background noise where possible.

 Censorship and Banned Topics

  • YouTube has extensive Community Guidelines that prohibit a range of content, including hate speech, graphic violence, and topics that promote harmful or dangerous behavior to oneself or others. Other restrictions include sexually suggestive content that exploits, abuses, or endangers children, or subject matter that may be viewed as cyberbullying, excessive cursing, or any content that violates intellectual property rights.

 Additional Recommendations

  • Local Recording: We use sophisticated podcasting software that will record your audio and visual locally and then upload after the show has concluded. This improves video quality and reduces pixelation or audio gaps, or drop-offs. You will be required to download this into your browser to participate.

  • Name & Audio Settings: Ensure your display name is correct and your preferred microphone is selected in the recording platform.

  • Soundcheck: If this is your first podcast, make a 30-second test recording in advance to confirm audio and video quality.
